Royal Country 4596, 18-A Floor, Torre Cube 2, Fraccionamiento Puerta de Hierro, in the City of Zapopan, State of Jalisco, and ZIP Code 45116. Being responsible for the legitimate processing of personal information, we advise that all the information we collect from our clients is of vital importance to accomplish the legal objectives our firm in all its areas of service provides. The present Privacy Policy´s aim is to notify you about the data processing of your personal information, whenever such is collected, utilized and/or stored by Rodríguez Zúñiga y Asociados. The described actions will be compliant with the Ley Federal de Protección de Datos en Posesión de Particulares, its administrative Regulation and the following guidelines.

If you are a CLIENT or a POTENTIAL CLIENT:

  • Accreditation and confirmation of your identity
  • Serve your legal, corporate and administrative needs, in general.
  • Provide you with legal counsel.
  • Provide advice, certainty and security on all the legal acts that you celebrate or execute, such as voluntary jurisdiction, legal disputes, any kind of contract or agreement, certification, signature ratification, notarization of fact, entity constitutions, meeting minutes, corporate books, legal proxy, etc.
  • Provide all the services and perform all the activities that are necessary in order to provide an adequate legal defense, in any legal proceeding.
  • In order to send the pertinent information about your corporate, administrative and other legal matters we are in charge of.
  • Advice in order to comply with the applicable Municipal, State and Federal legal requirements.
  • Exercise in representation, in case such has been granted and requested, all kinds of rights and actions against any Federal, State and Municipal authority.
  • Advice regarding the compliance of obligations with any third party that derives from any kind of legal relationship.
  • Elaboration, examination, update and conservation of files for the provision of any requested service and for use in future services.

If you are a PROVIDER or a POTENTIAL PROVIDER:

  • Have registry of your services as a provider
  • Elaborate the necessary legal documents to evidence the legal relationship you have with us.
  • Cancel payments and perform billings, in case it is needed.

In addition, we may also utilize information that is not directly necessary for the requested services, but it will allow us to provide you a better service. Such will have the following secondary purposes:

  • Statistical records and quality review of our services
  • Offer if other services that are closely related with ones already provided.
  • Bulletins and newsletters of our firm.

Data to be Processed and Collected Information

We inform that in order to accomplish with the primary and secondary objectives mentioned in this Privacy Policy, we may collect your personal data whenever they are provided via telephone, fax or electronic mail, as well as other forms of public domain that are permitted by law.   • Identification Data: name, occupation, address, phone number, cellphone number, fax number, place and date of birth, age, marital status, Unique Population Registry Code, Tax Identification Number, Voters Registration Card, Passport, Driver´s License, Military Identity Card or Professional License.
  • Employment Data: company, position, activities performed, company´s address, employment contract, company assigned electronic mail, phone number and/or fax.
  • Patrimony Data: income, bank accounts, credits, assets and liabilities, financial states, billing data
  • Personal data: Information regarding spouse, heirs, devisee or legatee, beneficiaries, co-owners, partners, official proof and photo that demonstrate your identity.

Transferance of the Collected Information

Your personal data will only be processed by the personnel and staff assigned to this Law Firm, in order to elaborate the pertinent legal documents, query responses and opinions that are requested. Therefore your personal data will not be transferred to third parties, with the exception of compliance with the legal obligations to the competent authorities; such as municipal, state or federal government offices, as well as judicial, administrative, tax, land registry and public record authorities. In the case of transference to private entities, such will take place only in matters related to our clients’ interests.


ARCO Rights

The right holder of the personal data or its legal representative, can exercise Access, Rectificacion, Cancelation and Oposition rights (hereinafter “ARCO Rights”) regarding his personal data.


ARCO rights consist of the following:


  • ACCESS: The right of the right holder to know that his personal data is being held by Rodríguez Zúñiga y Asociados S.C., as well as its destination, transference and general utilization
  • RECTIFICATION: The right of the right holder to request the correction of his personal information, in case such is outdated, inexact or incomplete.
  • CANCELLATION: The right of the right holder to request the elimination of his files in our database, whenever he considers that such information is not being managed following the principles, duties and obligations established in the legal regulations.
  • OPPOSITION: The right of the right holder to disapprove the use his personal data for specific objectives

Exercise of ARCO Rights

In order to exercise your ARCO Rights, you must file a request either personally at the offices of this Law Firm, located in the address specified at the beginning of this Privacy Policy, or you can send an email to contacto@rozasoc.com


Such request should at least contain the following:

  • The general information of the right holder, as well as the method he would like to be contacted by.
  • He must attach a document by which he gives proof of his identity or if such is the case, the legal representation of such right holder.
  • A clear and precise description of the personal data in relation to which he aims to exercise any of the ARCO Rights.

Revocation

Also, such right holder can revoke his consent, in case he has previously granted such for the processing of his personal data. Nevertheless, it is important for the right holder to have in mind that in some cases and scenarios we will not be able to process his request or conclude such processing immediately.
